FlipSeats, Inc. (“FlipSeats,” “our,” “us,” or “we”) respects your privacy. We created this Privacy Policy to let you know what information we collect when you access or use this online service, including the Service at flipseats.com., made available by FlipSeats to you pursuant to the Terms of Service and End User License Agreement (the “Service”), and how we use it, as well as our information sharing and protection practices.
This Privacy Policy applies to:
- The Service; and
- Any email, text, or other electronic communications you send to FlipSeats.
This Privacy Policy does not apply to:
- Information we collect through other websites, products, or services we may offer; and
- Information collected by third parties related to providing the Service (i.e. those identified in the Terms of Service and End User License Agreement), which may have their own privacy policies.
Please read this Privacy Policy carefully and save it. If you do not agree with it, do not access or use the Service. By accessing or using the Service or by submitting electronic communications to us through the Service, you consent to the practices prescribed in this Privacy Policy.
What information does FlipSeats collect?
- Personal Information. When we refer to “Personal Information” in this Privacy Policy, we mean any information by which you may be personally identified or contacted (i.e. first and last name, physical/mailing address, email address, phone number, etc.) whether online or offline but excluding Billing/Payment Information. It is always your choice whether or not to provide Personal Information. If you choose not to provide requested Personal Information, you may not be able to use certain features of the Service.
- Billing/Payment Information. When you purchase and use the Service, we, and other third-party financial service providers identified in our Terms of Service, will collect certain banking, credit card, or other payment information from you which allows us to debit/credit your accounts for transactions initiated and completed through the Service (“Billing/Payment Information”). It is always your choice whether or not to provide Billing/Payment Information. If you choose not to provide requested Billing/Payment Information, you may not be able to use certain features of the Service, including but not limited to receiving payment and/or listing additional tickets for sale.
- Technical Information. We may also collect and use technical data and related information, such as information about your device, system and application software, peripherals, and other data related to your interactions with the Service (“Technical Information”). We may automatically collect Technical Information through cookies, flash cookies, web beacons, log files, and similar technological devices. The information we collect from these technologies may include your IP address, device ID, browser information, and the page(s) you request. FlipSeats does not consider this information to be Personal Information.
- Geo-Location Information. We may also collect information about your geographic location from you or your device, including your country, region, city, zip code, street address, time zone, latitude, longitude, velocity, bearing, altitude, and horizontal position representation information (“Geo-Location Information”).
- Online Tracking and Do Not Track Signals. We may use the Service to collect information from your web browser or computing device about your activities over time and across third-party websites, applications, or other online services (“Online Tracking Information”). Your web browser and computing device may allow you to opt out of our collection of Online Tracking Information by selecting a “do not track” (or similar) setting. However, we do not currently have processes to address those settings or other “do not track” requests. Accordingly, we cannot guarantee that we will honor such requests. If you do not want us to collect this information, do not use the Service.
- Data You Upload. Data you upload to the Service (excluding Personal Information and Billing/Payment Information) for the purpose of using the Service including tickets, ticket vendors and suppliers, purchases, sales and similar transactions, notes, and descriptions is automatically collected and stored by us (“Native Data”). If you choose not to provide requested Native Data, you may not be able to use certain features of the Service.
Third-Party Data Sources. Portions of the Service allow you to access, collect, store, process, and transfer your data to and from third-party platforms (i.e. Points of Sale platforms, financial accounting services like QuickBooks®, and online marketplaces like Ticketmaster®). The Service may access, collect, store, process and transfer such data as necessary to provide you with the Service (“Sourced Data”). - User Tax Details. We, and other third-party financial service providers as identified in our Terms of Service, may collect information from you when you use our Service as a seller, including additional identification data such as tax identification numbers, and other required information that you provide (“User Tax Details”). It is always your choice whether or not to provide User Tax Details. If you choose not to provide requested Billing/Payment Information, you may not be able to use certain features of the Service, including but not limited to receiving payment and/or listing additional tickets for sale.
How does FlipSeats use Information?
Except as described in this Privacy Policy or in our Terms of Service and End User License Agreement or similar document, Personal Information, Technical Information, Geo-Location Information, Online Tracking Information, Native Data, and Sourced Data (collectively ,“Information”) that you provide or that we collect will be kept confidential and used to support your relationship with FlipSeats.
We may use your Information, including your Personal Information, as follows:
- To provide support and other services to you related to the Service.
- For order fulfillment, billing, and delivery purposes.
- To improve, market, or promote FlipSeats’s products and services.
- To alert you to product upgrades, special offers, updated information, and other new products and services offered by FlipSeats or its third-party business associates.
- To respond to comments, questions, or requests for customer service.
- To display advertisements.
- For any other purpose we may describe when you provide the Information.
- We may also use your Information for any other purpose with your consent which may be given by you supplying information to us through a fillable form, checking a consent, field, or other action by you indicating consent.
Billing/Payment Processing/Taxes
We use Dwolla to provide payment functions for your use of the Service. Please see our Terms of Services for more detail. Your Billing/Payment Information and User Tax Details will be shared with our financial institution(s) and third-party service providers, like Dwolla, and identified in our Terms of Service, to the extent necessary to process payments and will, otherwise, be kept confidential and subject to the terms of third-party financial service providers’ policies as identified in our Terms of Service. Your User Tax Details will be shared with our financial institution(s), state and/or federal taxing authorities only to the extent necessary to process payments and file necessary tax reports and will, otherwise, be kept confidential.
Data and Blind Data
You own all right, title, and interest in and to any data (excluding Technical Information) that we collect from you via your use of and interaction with the Service (“Data”). We do not consider this to be Personal Information. However, you grant us a perpetual, irrevocable, worldwide, royalty-free, fully-paid-up, nonexclusive, sublicensable, transferable license to use any data we collect based on your use of the Service in order to provide, monitor, and improve the Service and to compile, synthesize, and analyze this Data (“Blind Data”), such as to generate anonymous usage statistics. If we generate Blind Data, it will be owned by us and we may use it for any lawful business purpose. Any Blind Data will not personally identify you or the source of the Data.
Information We Share
Except as described in this Privacy Policy, FlipSeats does not share, rent, or sell your Information collected through the Service with third parties, including affiliates.
FlipSeats or its agents, vendors, or contractors may disclose Information, including your Personal Information, Billing/Payment Information, and User Tax Details, to third parties in the following circumstances:
- To our agents, vendors, or contractors that we use to support the internal operations of our business who are required to keep the Information confidential and use it only for the purposes for which we disclose it to them;
- To process payments, and related financial and tax reporting, arising out of your use of the Service;
- To protect against fraudulent claims, unauthorized transactions, and identifying potential hackers and other unauthorized users;
- If required to do so by law, to comply with legal process or a governmental or regulatory request;
- To protect and defend the rights or property of FlipSeats or its agents or contractors;
- To enforce our Terms of Service and End User License Agreement or other FlipSeats agreements or policies;
- To act in urgent circumstances to protect the personal safety of users of the Service or the public; and
- As part of a transaction or potential transaction where FlipSeats merges with another organization, files for bankruptcy, or sells its assets or capital stock.
Security of Your Information
Only certain authorized FlipSeats staff can access your Information, and then only if your Information is relevant to their job duties. We maintain physical, electronic, and procedural safeguards designed to protect the Information. Despite the actions and precautions we take, no data transmissions over the internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of the Information, and you acknowledge and agree that you provide it to us at your own risk.
Third-Party Websites, Services, and Technologies
We may provide links or other connections to third-party websites and services within the Service or in other communications to you. These links may appear as a specific domain name or URL or may be activated by clicking on an advertisement or other icon or graphic. Please be aware that other websites and services, including those of third parties that you connect with through the Service, may collect information about you, including personally identifiable information. We cannot control and are not responsible for the information collection practices of any third-party websites and services. We encourage you to review their terms of use, privacy policies and any other legal notifications before using them or providing information to them.
International Transfers
Information collected from you may be stored and processed in the United States or any other country in which FlipSeats or its affiliates, subsidiaries, agents, or contractors maintain facilities. If you are accessing the Service from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your data to the United States and processing globally. By providing your Information, you consent to any transfer and processing in accordance with this Privacy Policy.
Please be aware that the governments, courts, and law enforcement, security, or regulatory agencies of a particular country may be able to obtain access to or disclosure of Information as permitted by the laws of that country.
Children’s Privacy
The Service is not intended for persons under the age of 18. We do not knowingly collect Information from children under 13. If you believe that we may have collected Information from a child under the age of 13, please contact us at help@flipseats.com.
Information Choices and Changes
We may need to communicate with you about the Service, and we may make certain commercial offers available to you from time to time. By creating an account on the Service, you consent to receive commercial messages (whether by phone, email, text, or push notifications) from us or our third-party business associates. You can stop receiving promotional emails from us by following the unsubscribe instructions in those emails. Note that unsubscribe is not available for certain emails concerning your relationship or dealings with us.
You can limit your browser or computing device from providing certain information by adjusting the settings in the browser, operating system, or device. Please consult the documentation for the applicable browser, operating system, or device for the controls available to you.
Depending on your browser, you may be able to remove and reject cookies from the Service by changing your browser settings. The default setting of many browsers is set to accept cookies until you change your settings. Please note that if you disable or refuse cookies, certain features of the Service may become inaccessible or may not function properly.
Changes to this Privacy Policy
This is our entire Privacy Policy and it replaces any earlier version. We may change this Privacy Policy by posting a new version within the Service, and it is your responsibility to review this Privacy Policy periodically. If we make material changes to our practices regarding the collection, use, and sharing of your Personal Information, we will notify you via e-mail to the email address you provide to us and/or through a notice on the Service.
When we do change the Privacy Policy, we will also update the “Revised” date. Your continued use of the Service after such date constitutes your agreement to this Privacy Policy and any updates.
Your Privacy Rights
If you are a resident of a state that has adopted privacy regulation, you may have additional certain rights regarding your personal information. This includes:
- Right to Know – You may have the right to know what personal information we collected about you, including the categories of personal information, the categories of sources from which it is collected, the business or commercial purposes for collecting, selling, or sharing it, and the categories of third parties to whom we disclose it.
- Right to Access and Data Portability – You may have the right to request a copy of the personal information that we collected about you during the 12 months before your request.
- Right to Deletion – You may have the right to request that we delete information that we collected from you and retained.
- Right to Opt-Out of Selling or Sharing – You may have the right to opt-out of having your personal information sold or shared. To opt-out, click the “Do Not Share My Personal Information” link on the bottom of the webpage. Some web browsers allow consumers to automatically exercise their right to opt-out of sale/sharing with all businesses they interact with online by initiating an opt-out preference signal. We will honor such opt-out preference signals.
In order to request, deletion or a copy of your personal information, you may forward verifiable consumer requests to FlipSeats through one of the following methods:
- Calling FlipSeats at (866) 278-FLIP;
- Submitting a written request to help@flipseats.com.
Only you, or someone legally permitted to act upon your behalf, may make a verifiable consumer request. For example, you may make a verifiable consumer request on behalf of your company.
In order to submit a verifiable consumer request to FlipSeats, the request must both provide sufficient detail for FlipSeats to be able to appropriately ascertain your identity and give sufficient clarity for FlipSeats to understand the nature of the request. FlipSeats will determine the criteria for a verifiable consumer request based upon the nature of the request and account.
If you have submitted a verifiable consumer request, FlipSeats will respond in a timely manner consistent with applicable law.
